WHAT ARE COOKIES?

This allows Satori Health u0026amp; Wellness Coaching Ltd to track certain websites you visit. Web beacons are used to track online behavioral habits for marketing purposes to determine products or services you may be interested in. It is our practice to seek appropriate protection for information in these types of transactions. DATA SECURITY

The security of your personal information is extremely important to us. We use technical security measures to prevent the loss, misuse, alternation or unauthorized disclosure of information under our control. We use security measures including and not limited to: physical, electronic and managerial procedures to safeguard and secure the information we collect online. All sensitive information is collected on a secure server. 

We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once we receive it.  However, since no security system is impenetrable and “perfect security” does not exist on the Internet, or that information you supply will not be intercepted while being transmitted to us over the Internet.  Therefore, we cannot guarantee its absolute security of our databases.

When creating an account and asked to choose a password, in which case your online account information shall be protected by your password. We recommend that you do not disclose your password to any other person. You are responsible for maintaining the confidentiality of your password and account, and are fully responsible for all activities that occur under your password or account.

HOW LONG WE RETAIN YOUR INFORMATION

This section sets out how long we retain your information. We have set out specific retention periods where possible. Where that has not been possible, we have set out the criteria we use to determine the retention period.

Retention periods

  • Server log information: we retain information on our server logs for 12months.
  • Order information: when you place an order for goods and services, we retain that information for six years following the end of the financial year in which you placed your order, in accordance with our legal obligation to keep records for tax purposes.
  • Correspondence and enquiries: when you make an enquiry or correspond with us for any reason, whether by email or via our contact form we will retain your information for as long as it takes to respond to and resolve your enquiry, and for 24 further month(s) after which point we will delete your information.
  • E-Newsletter: we retain the information you used to sign up for our e-newsletter for as long as you remain subscribed (i.e. you do not unsubscribe) or if we decide to cancel our e-newsletter service, whichever comes earlier.

CRITERIA FOR DETERMINING RETENTION PERIODS

In any other circumstances, we will retain your information for no longer than necessary, taking into account the following:

  • the purpose(s) and use of your information both now and in the future (such as whether it is necessary to continue to store that information in order to continue to perform our obligations under a contract with you or to contact you in the future);
  • whether we have any legal obligation to continue to process your information (such as any record-keeping obligations imposed by relevant law or regulation);
  • whether we have any legal basis to continue to process your information (such as your consent);
  • how valuable your information is (both now and in the future);
  • any relevant agreed industry practices on how long information should be retained;
  • the levels of risk, cost and liability involved with us continuing to hold the information;
  • how hard it is to ensure that the information can be kept up to date and accurate; and
  • any relevant surrounding circumstances (such as the nature and status of our relationship with you).

Transmission of information over the internet is not entirely secure, and if you submit any information to us over the internet (whether by email, via our website or any other means), you do so entirely at your own risk.

We cannot be responsible for any costs, expenses, loss of profits, harm to reputation, damages, liabilities or any other form of loss or damage suffered by you as a result of your decision to transmit information to us by such means.

  • to withdraw your consent to our use of your information at any time where we rely on your consent to use or process that information. Please note that if you withdraw your consent, this will not affect the lawfulness of our use and processing of your information on the basis of your consent before the point in time when you withdraw your consent.

Where you request access to your information, we are required by law to use all reasonable measures to verify your identity before doing so.

These measures are designed to protect your information and to reduce the risk of identity fraud, identity theft or general unauthorized access to your information.

Where we possess appropriate information about you on file, we will attempt to verify your identity using that information.

If it is not possible to identity you from such information, or if we have insufficient information about you, we may require original or certified copies of certain documentation in order to be able to verify your identity before we are able to provide you with access to your information.

We will be able to confirm the precise information we require to verify your identity in your specific circumstances if and when you make such a request.

YOUR RIGHT TO OBJECT TO THE PROCESSING OF YOUR INFORMATION FOR CERTAIN PURPOSES

SENSITIVE PERSONAL INFORMATION

‘Sensitive personal information’ is information about an individual that reveals their racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, genetic information, biometric information for the purpose of uniquely identifying an individual, information concerning health or information concerning a natural person’s sex life or sexual orientation.

We do not knowingly or intentionally collect sensitive personal information from individuals, and you must not submit sensitive personal information to us.

If, however, you inadvertently or intentionally transmit sensitive personal information to us, you will be considered to have explicitly consented to us processing that sensitive personal information under Article 9(2)(a) of the General Data Protection Regulation. We will use and process your sensitive personal information for the purposes of deleting it.

CHANGES TO OUR PRIVACY POLICY

We update and amend our Privacy Policy from time to time.

Minor changes to our Privacy Policy:  Where we make minor changes to our Privacy Policy, we will update our Privacy Policy with a new effective date stated at the beginning of it. Our processing of your information will be governed by the practices set out in that new version of the Privacy Policy from its effective date onwards.

Major changes to our Privacy Policy or the purposes for which we process your information:   Where we make major changes to our Privacy Policy or intend to use your information for a new purpose or a different purpose than the purposes for which we originally collected it, we will notify you by email (where possible) or by posting a notice on our website.

We will provide you with the information about the change in question and the purpose and any other relevant information before we use your information for that new purpose.

Wherever required, we will obtain your prior consent before using your information for a purpose that is different from the purposes for which we originally collected it.

CHILDREN’S PRIVACY

Because we care about the safety and privacy of children online, we comply with the Children’s Online Privacy Protection Act of 1998 (COPPA). COPPA and its accompanying regulations protect the privacy of children using the internet. We do not knowingly contact or collect information from persons under the age of 18. The website is not intended to solicit information of any kind from persons under the age of 18.

It is possible that we could receive information pertaining to persons under the age of 18 by the fraud or deception of a third party. If we are notified of this, as soon as we verify the information, we will, where required by law to do so, immediately obtain the appropriate parental consent to use that information or, if we are unable to obtain such parental consent, we will delete the information from our servers. GENERAL DATA PROTECTION REGULATION (GDPR)

Definitions

  1. Data Protection Legislation means European Directives 95/46/EC and 2002/58/EC, and any legislation and/or regulation implementing or made pursuant to them, or which amends or replaces any of them (including the General Data Protection Regulation, Regulation (EU) 2016/679);
  2. Data Processor”, Data Subject, Processor, Processing, Subprocessor, and Supervisory Authority shall be interpreted in accordance with applicable Data Protection Legislation;
  3. Personal Data as used in this Addendum means information relating to an identifiable or identified Data Subject who visits or engages in transactions through your store (a “Customer”), which Satori Health u0026amp; Wellness Coaching Ltd. Processes as a Data Processor in the course of providing you with the Services. Notwithstanding the foregoing sentence, Personal Data does not include information that Satori Health u0026amp; Wellness Coaching Ltd. processes in the context of services that it provides directly to a consumer, such as through its consumer-facing applications or its consumer-facing services like Satori Health u0026amp; Wellness Coaching Ltd. Payments; and
  4. All other capitalized terms in this Addendum shall have the same definition as in the Agreement.

DATA PROTECTION

  1. Where a Data Subject is located in the European Economic Area, that Data Subject’s Personal Data will be processed by SATORI HEALTH u0026amp; WELLNESS COACHING LTD. Canadian based servers. 
  2. When Satori Health u0026amp; Wellness Coaching Ltd. Processes Personal Data in the course of providing the Services, Satori Health u0026amp; Wellness Coaching Ltd. will:
  • Process the Personal Data as a Data Processor, only for the purpose of providing the Services in accordance with documented instructions from you (provided that such instructions are commensurate with the functionalities of the Services), and as may subsequently be agreed to by you. If Satori Health u0026amp; Wellness Coaching Ltd.is required by law to Process the Personal Data for any other purpose, Satori Health u0026amp; Wellness Coaching Ltd. will provide you with prior notice of this requirement, unless Satori Health u0026amp; Wellness Coaching Ltd.is prohibited by law from providing such notice;
  • notify you if, in ‘Around’ opinion, your instruction for the processing of Personal Data infringes applicable Data Protection Legislation;
  • notify you promptly, to the extent permitted by law, upon receiving an inquiry or complaint from a Data Subject or Supervisory Authority relating to Around’ Processing of the Personal Data;
  • implement and maintain appropriate technical and organizational measures to protect the Personal Data against unauthorized or unlawful processing and against accidental loss, destruction, damage, theft, alteration or disclosure. These measures shall be appropriate to the harm which might result from any unauthorized or unlawful processing, accidental loss, destruction, damage or theft of Personal Data and appropriate to the nature of the Personal Data which is to be protected;
  • provide you, upon request, with up-to-date attestations, reports or extracts thereof where available from a source charged with auditing Around’ data protection practices (e.g. external auditors, internal audit, data protection auditors), or suitable certifications, to enable you to assess compliance with the terms of this Addendum;
  • notify you promptly upon becoming aware of and confirming any accidental, unauthorized, or unlawful processing of, disclosure of, or access to the Personal Data;
  • ensure that its personnel who access the Personal Data are subject to confidentiality obligations that restrict their ability to disclose the Customer Personal Data; and
  • upon termination of the Agreement, Satori Health u0026amp; Wellness Coaching Ltd. will promptly initiate its purge process to delete or anonymize the Personal Data. If you request a copy of such Personal Data within 60 days of termination, Satori Health u0026amp; Wellness Coaching Ltd. will provide you with a copy of such Personal Data.
  1. In the course of providing the Services, you acknowledge and agree that Satori Health u0026amp; Wellness Coaching Ltd. may use Subprocessors to Process the Personal Data. Satori Health u0026amp; Wellness Coaching Ltd.’ use of any specific Subprocessor to process the Personal Data must be in compliance with Data Protection Legislation and must be governed by a contract between Satori Health u0026amp; Wellness Coaching Ltd. and Subprocessor.
